These Terms of Service ("Terms") govern your access to and use of the Resonance website located at resonance.game (the "Site"), operated by Kangy Roo Creative LLC, a Virginia limited liability company ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
You must be at least 13 years of age (or 16 years of age if you are located in the European Economic Area) to access or use the Site. By using the Site, you represent and warrant that you meet this requirement.
The Site is provided for informational and promotional purposes related to the video game Resonance, currently in development. You may browse the Site and subscribe to our newsletter. You agree not to:
All content on the Site — including but not limited to text, graphics, character designs, character names, storylines, logos, artwork, visual identities, user interface design, sound, and game concepts — is the exclusive property of Kangy Roo Creative LLC or its licensors and is protected by applicable copyright, trademark, trade dress, and intellectual property laws of the United States and other jurisdictions.
RESONANCE, the Resonance logo, and all character names and visual identities associated with the game are claimed intellectual property of Kangy Roo Creative LLC. Trademark registration applications may be pending.
You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content, information, software, or materials obtained from or through the Site without our express prior written permission.
The distinctive visual aesthetic, art direction, character design language, color palette, compositional style, and overall look and feel of the Resonance game and associated materials constitute protectable trade dress and/or proprietary creative expression owned by Kangy Roo Creative LLC. You may not systematically study, reverse-engineer, imitate, or replicate the visual style, aesthetic, or character design language of Resonance for commercial purposes or to create competing or derivative works without our express written consent.
Notwithstanding any other provision of these Terms, you expressly agree that you will not use any content, images, artwork, character designs, text, visual materials, or other data obtained from or through the Site, directly or indirectly, to:
Any use of Site content for AI training purposes is a material breach of these Terms and may result in legal action including claims for copyright infringement, misappropriation, and injunctive relief.
Kangy Roo Creative LLC respects intellectual property rights and expects users to do the same. If you believe that any content on the Site infringes your copyright, please send a written notice to us at info@kangyroocreative.com containing: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location on the Site; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized by the copyright owner; (e) a statement under penalty of perjury that the information in your notice is accurate; and (f) your physical or electronic signature.
If you believe content was wrongfully removed in response to a DMCA notice, you may submit a counter-notification to the same address.
We love our community. Non-commercial fan art featuring Resonance characters is permitted under the following conditions:
Any fan art that does not comply with these conditions, or any commercial derivative work, is strictly prohibited without our express prior written consent. We reserve the right to revoke permission for fan art at any time and for any reason.
The Site may display trademarks, logos, or content belonging to third parties, including music labels and their associated artists. All third-party trademarks are the property of their respective owners. Their appearance on the Site does not imply endorsement, sponsorship, partnership, or affiliation with Kangy Roo Creative LLC unless explicitly stated.
"Monstercat" and the Monstercat logo are trademarks of CMG MCAT Holdings, LLC. All music referenced on the Site is the property of its respective rights holders. Music licensing is governed by separate agreements between Kangy Roo Creative LLC and the applicable rights holders.
All visuals, artwork, screenshots, and other media displayed on the Site represent artist-directed concept art and work-in-progress materials created during active development. These materials are subject to change. Final in-game assets, features, gameplay mechanics, story content, and other elements of the finished product may differ materially from what is shown on the Site.
The creative tools, production pipelines, workflows, and methodologies used in the development of Resonance — including those used to produce artwork and visual assets — are proprietary to Kangy Roo Creative LLC. All creative output shown on the Site is the result of deliberate artistic direction, creative decision-making, and iterative refinement by the development team. Kangy Roo Creative LLC claims full authorship and intellectual property ownership of all such works regardless of the tools or technologies employed in their creation.
Nothing on the Site constitutes a guarantee, promise, or commitment regarding the final product's features, content, quality, release date, pricing, or platform availability.
If you subscribe to our newsletter, you agree to receive periodic email communications from us regarding Resonance development updates, announcements, and related content. You may unsubscribe at any time using the link provided in each email or by contacting us directly. Our handling of your email address is governed by our Privacy Policy.
The Site and all content on it are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be available uninterrupted or error-free, that any information on the Site is accurate or current, that the Site is free of harmful components, or that the game Resonance will be released or that its features will match any descriptions on the Site.
To the maximum extent permitted by applicable law, Kangy Roo Creative LLC and its members, managers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, use, goodwill, or other intangible losses — arising out of or related to your access to, use of, or inability to use the Site or any content thereon, regardless of the theory of liability and even if we have been advised of the possibility of such damages.
In no event shall our total aggregate liability to you for all claims arising from or related to the Site exceed one hundred US dollars ($100.00).
You agree to indemnify, defend, and hold harmless Kangy Roo Creative LLC and its members, managers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit to or through the Site.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site ("Dispute") shall be resolved exclusively through binding individual arbitration, except that either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration, including but not limited to claims of intellectual property infringement or misappropriation.
Arbitration shall be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The arbitration shall be seated in the Commonwealth of Virginia, United States. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You and Kangy Roo Creative LLC each waive any right to participate in a class action lawsuit or class-wide arbitration. All Disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
If any portion of this arbitration provision is found unenforceable, that portion shall be severed and the remaining arbitration obligations shall continue in full force.
The Site may contain links to third-party websites or services (including Steam, social media platforms, and music streaming services). We are not responsible for the content, practices, or privacy policies of these external sites. Accessing them is at your own risk.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. To the extent that any Dispute is not subject to arbitration under Section 13, you consent to the exclusive jurisdiction of the state and federal courts located in the Commonwealth of Virginia.
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kangy Roo Creative LLC with respect to your use of the Site and supersede all prior or contemporaneous communications and proposals, whether oral or written.
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
